Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to use PhotoTask
• One account per person - multiple accounts are not permitted

Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these terms or engage in harmful behavior.

Prohibited Activities

• Creating fake or misleading photo requests
• Uploading inappropriate, offensive, or illegal content
• Attempting to fulfill your own requests
• Harassing, threatening, or abusing other users
• Violating any applicable laws or regulations
• Attempting to hack, disrupt, or damage our service

Content Guidelines

• Photos must be relevant to the request description
• Respect privacy and property rights when taking photos
• Do not upload photos of people without their consent
• Ensure photos are appropriate for all audiences

Your Content

You retain ownership of photos you upload to PhotoTask. By uploading content, you grant us a license to display, distribute, and use your content as necessary to provide our service.

Our Content

PhotoTask and its original content, features, and functionality are owned by Maison du Code LLC and are protected by international copyright, trademark, and other intellectual property laws.

Service Disclaimer

PhotoTask is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not guarantee that photo requests will be fulfilled, that photos will meet your expectations, or that the service will be uninterrupted or error-free.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Maison du Code LLC, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from or relating to these terms or the service shall not exceed the amount you paid us for the service in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Force Majeure

We shall not be liable for any failure or delay in performance under these terms which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, labor disputes, or any other cause which is beyond our reasonable control.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal action or proceeding arising under these terms will be brought exclusively in the federal or state courts located in San Francisco County, California.

Dispute Resolution

Before filing any legal action, you agree to first attempt to resolve any dispute through good faith negotiations. If we cannot resolve the dispute within 60 days, either party may initiate binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

Class Action Waiver

You agree that any arbitration or court proceeding will be limited to the dispute between you and PhotoTask individually. You waive any right to participate in class actions, collective actions, or consolidated proceedings.

European Union (GDPR)

For users in the European Union, these terms are subject to the General Data Protection Regulation (GDPR) and other applicable EU laws. Key provisions include:

• Data processing based on lawful grounds as specified in our Privacy Policy
• Your right to withdraw consent at any time
• Right to data portability and erasure
• Right to object to processing based on legitimate interests
• Right to lodge complaints with supervisory authorities

United Kingdom (UK GDPR)

For users in the United Kingdom, these terms comply with UK GDPR and the Data Protection Act 2018. All GDPR rights and protections apply as specified above.

California (CCPA/CPRA)

For California residents, these terms comply with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). You have specific rights regarding your personal information:

Content Review Process

We reserve the right to review, moderate, and remove content that violates these terms or applicable laws. This includes but is not limited to automated screening, user reports, and manual review processes.

Prohibited Content

• Illegal activities or content that violates applicable laws
• Harassment, threats, or abuse directed at individuals or groups
• Hate speech, discrimination, or content promoting violence
• Sexually explicit or inappropriate content
• Spam, fraudulent, or misleading content
• Content that infringes on intellectual property rights
• Content that violates privacy rights or contains personal information without consent

Enforcement Actions

Violations of these terms may result in warnings, content removal, account suspension, or permanent account termination. We will provide notice of enforcement actions when possible and allow for appeals in appropriate circumstances.
