1) Acceptance, Scope, and Definitions
- By installing or using PhotoTask you agree to these Terms, the Privacy Policy, the Community Guidelines, and feature notices.
- “You” is the individual user; “we/us” is Maison du Code LLC; “Service” is PhotoTask apps, APIs, and sites.
- Conflict order: feature terms > these Terms > guidelines; app store terms govern billing/refunds.
2) Eligibility and Accounts
- 18+ only; not for children under 13 (or under 16 where required). One account per person; no shared/automated accounts.
- Provide accurate info; secure credentials; notify us of compromise. Identity verification may be required for safety, fraud, or legal reasons.
- We may suspend/terminate for violations, fraud, safety risk, legal process, or platform rule breaches.
3) Nature of the Service
PhotoTask enables private person-to-person photo delivery and location-based task requests.
All interactions occur privately between requesters and fulfillers. PhotoTask does not provide: public posting, social feeds, content broadcasting, dating/matching services, or supervised meetups.
- Tasks: title, description, geofence, expiry, reward/points; must be lawful, safe, and non-invasive.
- Fulfillers: claim tasks, capture/upload photos/videos, edit before approval, receive approvals/rework feedback.
- Real-time maps/feeds show eligible tasks by location/time; claimed tasks may be hidden; history may be limited.
- Profiles: display name/avatar/bio; blocking/reporting limits visibility and interaction.
- Notifications: push/in-app/email for task events, approvals, comments, reactions, follows, moderation outcomes.
- Offline: short-lived map/task cache; low-risk queued actions with retries.
4) User-to-User Interactions
Important: PhotoTask facilitates communication but does not control or supervise user interactions.
- We do not verify user identities beyond basic account validation.
- We are not responsible for user behavior, content accuracy, or task outcomes.
- We do not mediate disputes between users.
- We make no guarantees about the accuracy of user-provided information.
- You agree to communicate respectfully and report misuse through in-app tools.
5) Roles, Subscriptions, and Billing
- Free: Base quotas and access.
- Pro: Higher quotas, premium visibility, higher upload limits, priority support, possible verification badge.
- Admin/Moderator: Elevated permissions for moderation/support; actions are logged.
- Billing via Apple/Google through RevenueCat; auto-renews until canceled in the store. Account deletion does not cancel store subscriptions. Trials convert unless canceled. Refunds follow store policy; fees otherwise non-refundable unless required by law. Price changes noticed per platform rules.
6) Acceptable Use and Platform Integrity
- No illegal, dangerous, hateful, or harassing conduct; no doxxing.
- No location spoofing, EXIF tampering, or bypassing geo-eligibility; no scraping, automated queries, or rate abuse.
- No reverse engineering, malware, or interference with security or APIs.
- No fraud: self-fulfilling tasks, fabricated submissions, fake reviews, entitlement tampering, or payment abuse.
- Respect property and local law; obtain consent where required; follow Community Guidelines.
7) Safety, Location, and Real-World Activity
- Foreground location is required for eligibility/proof-of-presence; background only if you enable it. Do not share others’ precise locations.
- Avoid sensitive sites (schools, hospitals, shelters) unless clearly lawful/appropriate. If unsafe, disengage.
- We may blur/decay precision, rate-limit queries, and apply anti-spoofing checks.
- You assume risks of real-world activity; comply with safety prompts and law.
8) Photo Content, Ownership, and Licensing
- You own your content. You grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, adapt for formatting/safety, distribute, display, and create derivative works to operate and improve the Service.
- For fulfilled tasks, you grant the requester a license to use delivered content per task terms. You waive moral rights as needed to operate the Service and deliver the task.
- We may retain or deanonymize fulfilled content to preserve task integrity, resolve disputes, and support safety records per the Privacy Policy.
- We may remove or limit content that violates law, these Terms, platform rules, or Community Guidelines.
9) Prohibited Content
Users may not upload or send:
- Illegal or harmful images
- Copyrighted photos without permission
- Nude or sexual content
- Violent or abusive content
- Photos of minors in unsafe or inappropriate contexts
We may remove content or suspend accounts that violate this rule without notice.
10) IP Complaints (DMCA)
Send DMCA-compliant notices to privacy@phototaskapp.com (signature, work, infringing material/location, contact, good-faith and perjury statements). We may remove content and terminate repeat infringers. Counter-notices may be submitted under 17 U.S.C. §512(g).
11) Privacy and Data
See the Privacy Policy for data collection, use, sharing, retention, rights, and transfers (GDPR/UK GDPR/CCPA/CPRA/PIPEDA and others). Do Not Sell/Share and sensitive data limits are honored via do-not-sell and in-app settings; we do not sell personal information. Location/media handling, anti-spoofing, security, and audit logging are described there.
12) Moderation, Reporting, and Appeals
- Reports are reviewed via a moderation queue; admin/mod actions are logged.
- We may warn, remove content, disable tasks, limit features, suspend, or terminate accounts.
- Appeals may be available; some actions (e.g., CSAM/illegal content) are not appealable.
13) Third Parties, App Stores, and Processors
- Billing: Apple/Google via RevenueCat; their terms govern payments, taxes, and refunds.
- Processors (e.g., Firebase, Postmark) support hosting, storage, auth, analytics, messaging as in the Privacy Policy.
- App store rules apply to content, billing, location disclosures, and reporting.
14) Technical Limitations and Availability
You understand that PhotoTask may experience:
- Bugs and software errors
- Delays in content delivery
- Network issues and connectivity problems
- Limited device compatibility
We do not guarantee continuous, error-free operation.
15) Support and Service Changes
- Service may be interrupted for maintenance, updates, or events outside our control. No uptime guarantees.
- Support is provided as-available; no formal SLAs unless separately agreed.
- Features may change or be deprecated; material changes will include notice where required.
16) Government, Legal Process, and Export
- We may preserve or disclose information to comply with law, legal process, or to protect safety, rights, or property.
- You must comply with export, sanctions, and embargo laws; do not use the Service in prohibited jurisdictions or by restricted parties.
17) Termination
- You may stop using or delete your account anytime; see Data Deletion for timelines.
- We may suspend/terminate for violations, fraud, safety, legal requests, or platform rule breaches.
- Licenses to us/requesters for fulfilled content survive as needed to operate the Service, resolve disputes, comply with law, and maintain task integrity.
18) Disclaimers and Limitation of Liability
- Service is provided “as is” without warranties (merchantability, fitness, non-infringement, availability).
- No guarantee of task fulfillment, media quality, or uninterrupted Service.
- To the fullest extent permitted, we are not liable for indirect, incidental, special, consequential, or punitive damages.
- To the fullest extent permitted by law, Maison du Code LLC’s total liability for any claim arising out of or relating to the App shall not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the total amount paid by you to us in the twelve (12) months preceding the claim.
- You assume risks of real-world activities; comply with safety and legal requirements.
- No personal liability of members, managers, employees, or agents of Maison du Code LLC.
19) Indemnification
You will indemnify and hold harmless Maison du Code LLC, affiliates, and personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, conduct, task creation/fulfillment, breach of these Terms, or violation of law or third-party rights.
20) Dispute Resolution and Class Waiver
- Governing law: California, USA (without conflict rules). Venue for non-arbitrable claims: state or federal courts in San Francisco County, California.
- Good-faith negotiation for 60 days before arbitration or litigation.
- Binding arbitration (AAA Commercial Rules) for disputes arising out of or relating to these Terms, except claims that cannot be arbitrated by law (e.g., IP injunctive relief).
- No class or representative actions; disputes are individual only.
21) Regional and Platform Requirements
- GDPR/UK GDPR: lawful bases, rights, and transfer safeguards per Privacy Policy.
- CCPA/CPRA: rights to know/delete/correct/opt-out/limit; non-discrimination; opt-out portal available.
- PIPEDA and other regimes: rights and complaint paths per Privacy Policy.
- Apple/Google: comply with in-app purchase, content, location, and reporting rules; Sign in with Apple where required.
22) Changes, Notices, and Survival
- We may update these Terms for product, legal, or operational reasons. Material changes will be noticed in-app and/or by email where required. Continued use after changes means acceptance; if you disagree, stop using the Service and request deletion.
- Notices may be provided in-app, by email, or through the Service.
- Survival: licenses, IP, payments owed, indemnity, disclaimers, limits of liability, dispute resolution, and termination effects survive.
